Please note the following: Purchases on this site are instant and non-refundable. This website is owned, managed and powered by The Ecotourspr Group, LLC. The supplier name on your credit card statement and receipt will be "The Ecotourspr Group, LLC"

This Website is owned and operated by The Ecotourspr Group, LLC. Use of this Website is subject to these Terms and Conditions.

 

Application of Terms and Conditions

These Terms and Conditions apply to any booking made through the website whether or not you are the activity participant (person actually undertaking the activity purchased on the website) or the original purchaser. If you are the original purchaser, it is your responsibility to fully inform all participants of these Terms and Conditions.

Please read these details and contact us if you need any further information or explanation. These Terms and Conditions are the most current of The Ecotourspr Group, LLC (Encantos Ecotours, Sailing Dreams and Beach Rafting & Kayaking Tours)

"Encantos Ecotours" means Encantos Ecotours and its parent and/or subsidiaries unless otherwise specified, "Sailing Dreams", means Sailing Dreams and its parent and/or subsidiaries unless otherwise specified, and "Beach Rafting & Kayaking Tours" means Beach Rafting & Kayaking Tours unless otherwise specified.

"Website" means the whole or any part of the web pages located at www.encantosecotours.com, www.ecotourspr.com, www.sailingdreamspr.com, www.beachrafting.com, or www.raftingpr.com or any derivation of these web page addresses and all associated affiliate websites, partner websites and other links to and from these websites.

"We" and "us" refers to The Ecotourspr Group, LLC, and "our" has the same meaning. Headings are for convenience and are not to be used to interpret these Terms and Conditions.

 

Bookings

The person making a booking acknowledges to have accepted these Terms and Conditions on behalf of everyone named in the booking. By booking an activity using the website you are agreeing to the following: The Ecotourspr Group, LLC are operators, as well as a booking agent. The Ecotourspr Group, LLC acts as agent for a third party supplier ("activity supplier") for the purposes of marketing the activity suppliers service.

The Ecotourspr Group, LLC does not guarantee that the website is free from errors or faults; we will however make our best efforts to ensure that the information available on the website is accurate.

 

Cancellation of an Activity

Our tours offer limited space to maintain their boutique feel and our personalized pampering service at its best. All sales are final. Please note we operate rain or sun, tours will NOT be cancelled because it is raining. If we cancel your reservation because of a tropical storm, hurricane or bad weather in general, we will offer you to reschedule, we will give you a Gift Certificate you can use in future tours, give to a friend or even sell, with no expiration date; or we will give you a full refund.

NO Gift Certificates, nor refunds will be made to any customer who chooses not to participate in a departing tour due to weather conditions or personal reasons. There will be no Reschedules or Gift Certificates given to no shows or late arrivals.

Excursions can be cancelled up to 48 hours without a cancellation fee. Customers can cancel a tour up to 48 hours before departure and receive a full refund. If you cancel in less than 48 hours of the scheduled departure, there is a 100 percent cancellation fee. All tours are non-refundable if not cancelled by customers 48 hours before tour departure.

We have no control over any delays or cancellations of cruise ships, or airlines. Please understand that we will be ready to complete your services. If you contact us before the scheduled departure time and as soon as you know there will be a delay, we might be able to reschedule your tour for a different time, or day. If there is no way you can reschedule, then we will give you a Gift Certificate you can use in future tours, give to a friend or even sell, with no expiration date. No shows and no notifications, prior to the scheduled departure time, will receive no Reschedule opportunity, nor a Gift Certificate. If there is no way you can attend your reserved excursion even in the future, you may contact your travel insurance provider. In many cases you will receive compensation.

 

About Weather and Weather Forecasts:

Weather Forecasts that you read days in advanced, are usually a general synopsis of the forecast for the entire Island of Puerto Rico. Please be aware that most of the time they are not given specifically for the San Juan Bay, where we do our tours. San Juan Bay are calm and protected waters. If we cancel 10 tours in a year, that’s a lot!

 

Session Lengths

Session lengths are approximate and are given as a guide to the total time you will be at their venue. Unless otherwise stated, you will normally take your turn with the activity supplier's other customers and there may be waiting time involved. Any itinerary provided to you is illustrative only and the order of events may change.

 

Restrictions

Certain activities provided by The Ecotourspr Group, LLC, or by activity suppliers are subject to minimum age, health or other requirements. Details of each activity requirements are set out on the website under each service. Please read them carefully.

We reserve the Right of Admittance. We reserve the right in our sole and absolute discretion to refuse admission to any person if circumstances reasonably so require and our decision shall be final and binding. We also reserve the right to suspend or cut short a tour if circumstances reasonably so require.

You will not be admitted if you arrive late. Nor will a refund be made should you arrive late, on the wrong day, or on the wrong hours.

 

Prices and Charges

Most of our prices are for one person, unless otherwise specified. Any booking made or order placed by you, whether through our website or otherwise, shall be deemed an offer by you to purchase the relevant activities subject to these Terms and Conditions. We reserve the right to change prices without notice. All prices will include Taxes, Management Fees and Handling of 18%.

 

Activity Descriptions

We try to ensure that our advertising information is accurate and up-to-date. However, the content or format of some activities may change slightly from time to time. Activity suppliers will provide final details about each activity. Your participation in each activity is conditional upon your acceptance of the activity supplier's Terms and Conditions.

• The Ecotourspr Group, LLC makes no specific representation as to the standard, class, or description of services provided by third parties including the activity suppliers.
• The Ecotourspr Group, LLC does not accept liability for any errors or omissions and reserves the right to change information published on the website at any time.
• The text used by The Ecotourspr Group, LLC is protected by copyright and must not be copied in whole or in part in any way without the express permission of The Ecotourspr Group, LLC.

Maps are shown for general information and may not necessarily reflect actual routes, locations or services provided. Photographs show places in the geographic areas, but may not be included in the activity.

Some activity photographs/descriptions are representative only.

We have taken all reasonable care to ensure that the content of the website is correct, but all information is subject to change at any time without notice.

No Liability for Inconvenience

Without limiting other clauses in these Terms and Conditions, The Ecotourspr Group, LLC is not liable for any inconvenience caused or expense incurred by use of the information provided on the website. To the maximum extent permitted by law The Ecotourspr Group, LLC disclaims all liability for any errors, unauthorized access to your personal information or inaccuracies in information supplied by third parties.

Under no circumstances will The Ecotourspr Group, LLC be liable for direct, indirect, consequential or incidental damages, including but not limited to lost profits or damages. The inclusion of an activity supplier on the website does not indicate that The Ecotourspr Group, LLC endorses or recommends that provider.

 

Liability Disclaimer

• The Ecotourspr Group, LLC makes no warranty or representation regarding the standard of any service to be provided by activity suppliers. The Ecotourspr Group, LLC has no liability for any act, omission or default, whether negligent or otherwise caused by any activity supplier.
• The Ecotourspr Group, LLC has no liability for any loss or damage occasioned by any negligent act or omission of any activity supplier or third party. Where The Ecotourspr Group, LLC's liability cannot be excluded, such liability is limited to the value of the activity purchased.
• The Ecotourspr Group, LLC does not accept liability for any indirect or consequential loss arising out of the use of or connected with the website or for any products or services purchased from the website.
• The Ecotourspr Group, LLC is not liable to you or any other person for any injury, damage or loss however caused in connection with the use of the website or a linked website or occasioned by undertaking an activity purchased from the website.

Nothing contained in these Terms and Conditions derogates from The Ecotourspr Group, LLC's right to comply with law enforcement requests or requirements relating to your use of this Website or information provided to or gathered by The Ecotourspr Group, LLC with respect to that use.

We will not honor any booking, gift certificate or credit (or any portion therein) which we believe have been stolen from the lawful purchaser or have otherwise been acquired using fraudulent financial means.

 

Changes to These Terms and Conditions

The Ecotourspr Group, LLC at any time may change or modify all or any part of these Terms and Conditions. The Terms and Conditions in force at the time of the booking will apply.

 

No Waiver

Any waiver of a breach of this Agreement shall be in writing signed by the party granting the waiver and shall be effective only to the extent specifically set out in that waiver.

 

Entire Agreement

This Agreement constitutes the entire Agreement between the parties with respect to the subject matter of this Agreement and supersedes all other negotiations, agreements, instruments and other writings between the parties. No variation or waiver of this Agreement or any part thereof shall be effective unless in writing signed by each of the parties.
